The Constitution and Bylaws Committee dealt with resolutions that change the UNE’s Bylaws or PSAC Constitution. The Committee met, in person, on June 7th to the 11th, 2026, at the Hotel Lac Leamy, in Gatineau to review all 46 resolutions that were assigned to it. The resolutions were submitted by locals, at regional seminars, and by a special bylaws review committee composed of Deputy Trustees in advance of the Pre-Convention Committee Meetings.

Resolutions that change the UNE by-laws require the support of 2/3 of voting delegates at this convention to be adopted.

Resolutions that impact the PSAC Constitution require a simple majority (> 50%) vote at this convention but would have to be adopted by a 2/3 margin, at the PSAC 2024 Triennial Convention, to be adopted.

Prior to the meeting, the PSAC National President reviewed the submitted resolutions and determined that CS-04 and CS-45 were not in order.  As a result, the Committee did not consider those resolutions. Careful and detailed consideration was afforded to all resolutions that were submitted. Of the 44 resolutions, deemed to be in-order, 38 received a recommendation of concurrence and 6 received a recommendation of non-concurrence from the Committee.

The Committee grouped some resolutions during its prioritization exercise so they could be dealt with and voted on more efficiently, allowing members to consider as many resolutions as possible.

The Committee established the following priorities for resolutions that received concurrence recommendations:

The first group of resolutions deal with editorial or minor changes. Should any resolutions in this group be removed they are to be dealt with after all other concurrence resolutions.

If there is a discrepancy between the English and French, the language of default will be the language in which the original resolution was submitted.

 

Many of the bylaw changes address some of the concerns that arose following the UNE’s 2023 convention. They also enshrine past practices that had been commonly understood and had been followed for many years by previous leaders. Those changes include:

  • More clearly defining the role and responsibilities of the national executive as the UNE’s supreme governing body between conventions;
  • Clarifying that the powers of the national president are not without limit and, like all other members of the national executive, the president is directly responsible to the national executive.
  • Ensure that any presidential rulings are communicated to the national executive and are formally reviewed by the national executive.
  • Clarifying that the role of the national president, as an ex officio member of all national executive committees, is not to vote on committee recommendations.

This organization will be known as the Union of National Employees (UNE), Public Service Alliance of Canada (PSAC). The UNE is an unincorporated association.

The UNE’s headquarters is located in the National Capital Region.

Committee Rationale:
The legal status of the UNE as an unincorporated association is included because, recently, some officers incorrectly stated that it was a charitable entity.

This reflects the longstanding practice that the national president attends such committees to provide information and guidance but does not vote. The president still has the right to vote at national executive meetings on committee recommendations.

Inactive Locals

Inactive locals

A local will be deemed to be inactive when

  1. a) the local has ceased to function;
  2. b) the local has failed to carry out its responsibilities; or
  3. c) the local fails to meet the requirements set out in Bylaw 3, Section 4 and 5 (Local officers); Bylaw 3, Section 5 (Local officers); Bylaw 3, Section 12 (Reporting Requirements); and Bylaw 5, Section 9 (Local Finances).; or
  4. d) no officers have been elected to the local, as per Bylaw 3, Section 4.

The regional vice-president shall report at each national executive meeting on all inactive locals in the region and advises whether those inactive locals should be placed in trusteeship.

The Committee recommends concurrence.


Committee Rationale:
Paragraph (d) is removed (and moved to paragraph c) because Bylaw 3, Section 4 requires that a local must have no fewer than three named officer positions. Therefore, a local would be inactive even if there are one or two of the named officers. Also, descriptors are added to provide some information about the bylaws referred to in paragraph c. The last sentence that is added repeats the proposed responsibility of RVPs in Bylaw 2 Section 20. (Normally, repetition is avoided in bylaws, but this reflects the focus on ensuring that locals are active locals.)

The financial records of the UNE are audited once a year by a firm of chartered or certified accountants approved by the national executive. When the audit is completed and approved, the UNE immediately posts a signed copy on the UNE website and sends a signed digital copy forwards one copy of the financial statement to each local and two copies to the Public Service Alliance of Canada.

Special National Conventions

Special National Conventions

A special National Convention is held when two-thirds of the national executive votes for such a convention or when 51 percent a majority of locals request it. A special National Conventions occurs at a time and place decided by the national executive.

Special National Conventions are composed of delegates elected by locals in accordance with the numerical table specified in Section 11 10 of this bylaw.

Special National Conventions deal only with the matters for which they are called unless the convention agrees by a two-thirds majority vote of assembled delegates to consider other urgent matters. Dealing with such issues will fall within the time limit set for the convention.

Discipline by national executive

The national executive has the authority to discipline—including remove from office—any UNE officer who contravenes any provision of these bylaws or the PSAC Constitution.

Any written complaints forwarded to the national executive within 90 calendar days of an alleged offence or within 90 calendar days of someone becoming aware of an alleged offence, may be investigated. The process followed in investigations is governed by the provisions of UNE Policies and the PSAC Constitution and Regulations.

The national president or the national executive may waive the 90 calendar-day timeframe.

All locals of the UNE may remove from office any officer for contravening a provision of the local’s bylaws, the UNE’s bylaws, or the PSAC Constitution. The provisions to be followed are governed by Regulation 19 of the PSAC Constitution.

Actions that can lead to penalties

An officer or member commits an offence by: 

  1. a)    violating any provision of the local bylaws or the UNE bylaws or policies;
  2. b)    using the name of a local, region, or the Union of National Employees in an inappropriate manner, or for soliciting funds or advertising, without the consent of the local, Regional Vice-President or national executive, whichever applies;
  3. c)    giving a complete or partial list or any information on the membership of the UNE or of any local to anyone other than those whose official position entitles them to have such a list;
  4. d)    any other conduct prejudicial to the good order and welfare of the UNE.

Amended Resolution CS 16
The National President

The Union of National Employees will amend Bylaw 2, Section 16 as follows:

Bylaw 2 Section 16

The national president:

  1. a) is a full-time paid officer;
  2. b) lives in the National Capital Region;
  3. c) functions as the chief executive officer of the UNE and, as such, supervises the affairs of the UNE and signs all official documents;
  4. d) follows and implements the decisions taken by the national executive;
  5. e) represents the UNE on the National Board of Directors of the Public Service Alliance of Canada as required by the PSAC Constitution;
  6. f) calls and presides at all regular and special meetings of the national executive in accordance with Bylaw 2, Section 7;
  7. g) is an ex-officio member of all committees of the national executive;
  8. h) presides at all sessions of the UNE Triennial Convention or special conventions, except for the elections of officers;
  9. i) when interpretsing the bylaws of the UNE, will provide notice which shall be posted on the UNE website and promptly sent to all members of the national executive, and is not in effect subject to review unless it receives formal approval by the national executive within thirty days of the notice.
  10. j) establishes – in consultation with the national executive, vice-president, the national vice-president for human rights and the vice-presidents for each region – establishes the members of all national executive committees;
  11. k) ensures that the national executive carries out the directives, policies, aims and aspirations of the union as established by the National Conventions of the Public Service Alliance of Canada and of the UNE;
  12. l) ensures that members of the national executive carry out their duties as described in these bylaws and gives them assistance and direction where necessary;
  13. m) ensures that the national executive is informed of all UNE affairs that affect the members they represent, and that such information is delivered to the national executive in a complete, relevant and timely manner;
  14. n) ensures that the national executive vice-president is informed of all matters relevant to UNE affairs;
  15. o) presides at all meetings of the UNE senior management team, which comprises the national president and excluded managerial staff. Such meetings will occur, at a minimum, once a month;
  16. p) ensures that the UNE senior management team carries out its day-to-day duties and that it implements decisions of the Triennial Conventions of both PSAC and the UNE;
  17. q) assesses and addresses—in consultation with the senior management team and the national executive vice-president—the staffing requirements of the UNE to ensure that the members are well served;
  18. r) abides by the UNE’s budget, as established by the Triennial Convention, and does not enter into any contractual or discretionary spending over $5,000 that has not until it has been pre-approved by the national executive;
  19. s) reports in writing on their activities and those of the UNE senior management team staff at all meetings of the national executive and forwards a copy to the presidents of all UNE locals;
  20. t) reports in writing to the UNE Convention on the president’s activities, and on the activities of the national executive and the UNE senior management team office. The report should also include recommendations for continuing the aims and objectives of the UNE and the Public Service Alliance of Canada;
  21. u) is the chief spokesperson for the UNE in dealings with the media, the public, and with the national heads of departments, and agencies, and other employers that fall within the jurisdiction of the UNE;

  2. b) Maintain their primary residence outside of the NCR and receive a receipted accommodation reimbursement for a residency in the NCR, in such amount as determined by the national executive – based on reasonable accommodation and market rates – subject to policies adopted by the national executive.

The selection made in paragraph shall remain in effect for the duration of the presidency and vice-presidency in any consecutive terms in either office. Any exceptions to this must be approved by the national executive.

This will provide UNE leadership with residency options similar to those available elsewhere within PSAC including two PSAC regions, USJE, and UVAE. This reflects a modernization in our approach to residency allowing for our values around remote and hybrid work to be honoured while mitigating impacts on family and family life as well as making the opportunity to run for UNE leadership more widely available to members throughout Canada. With respect to the budget, UNE already has a dedicated fund for moving these officers to and from their residence outside the NCR. The purpose of this fund could be expanded to pay for a residence in the NCR. This would ensure that the cost of either option is transparent to the membership.

Locals in Ottawa Centre and Ottawa North are in Ottawa, except for Local 70160 (Industry Science and Economic Development), which is Ottawa Centre to try to balance the size of the regions. It should be noted that since the last change to the UNE regions in the NCR, there are now fewer members on the Ottawa side than in Gatineau.

The number of delegates per local is based on the number of members in good standing in the local six months prior to the opening date of the convention:

  1. a) four to 100 200 members = two one delegates;
  2. b) one accredited delegate for each 100 200 members or portion thereof to a maximum of five delegates for any given local.

Committee Rationale:
The “one delegate per 200 members” formula was in effect until the 2011 convention. The return to this formula reduces the cost of convention and the current underrepresentation of larger locals. The ratio of delegates per member of our convention is significantly higher than most other Components. In fact, the number of convention delegates approaches that of the PSAC.

At this time the committee feels the position can safely be eliminated without negative impacts on the ability of the National Executive as well as the Labour Relations Officers to support members on matters of Health and Safety.

The Union of National Employees will in all locals establish a Racialized Officer position, held by a member of a racialized group of persons of non-white, non-Indigenous heritage who face systemic barriers, with a mandate to identify patterns of discriminatory treatment, advise the Local Executive on human rights and equity grievances, and serve as the Local's designated expert on matters of racial equity in the workplace.

The Committee recommends non-concurrence.


Committee Rationale:
This resolution would also create a challenge for locals to be in conformance if such positions could not be filled. While there are positive aspects to this resolution, the locals have the flexibility to create such positions based on needs and their ability.

The Union of National Employees will request PSAC amend Regulation 18 of the PSAC Constitution to provide that, upon placing a sub-organization into trusteeship, the elected offices of that sub-organization shall be vacated for the duration of the trusteeship and the compensation attached to those offices shall cease for that period; that any affected officer shall return to their substantive position without prejudice; and that this administrative measure shall not constitute discipline, removal for cause, or the termination of any separate employment relationship.

The Committee recommends non-concurrence.


Committee Rationale:
Trusteeship does not necessarily mean there has been fault or wrongdoing of the elected officers and it would be unfair to financially penalize them. Especially when there is no guarantee the member can return to their substantive position mid-term.

Committee Rationale:
The task of the human rights committee is outlined in Bylaw 2 Section 24 and 25 and they do not require additional direction. It is not the National Executive's role to direct the equity representatives on the nature of their priorities.

Most other Component Vice-Presidents are paid and the duties required for the position would not be able to be complete under a volunteer position. The committee believes this would reduce the quality of representation to UNE members. UNE is the most complex Component of the PSAC.
